Ski Fitting Science LLC d/b/a Wagner Custom ("Wagner Custom," “Us,” or “We”) is committed to protecting the privacy of the users of the www.WagnerSkis.com,  www.WagnerSnowboards.com, www.WagnerCustom.net, www.WagnerCustomSkis.com, www.WagnerCustomSnowboards.com, www.Winterstick.com, www.WinterstickSnowboards.com web sites (the “Sites”).  This privacy policy (the “Policy”) discloses Wagner Custom’s information privacy practices for the Sites and is intended to inform registered users and other visitors to the Sites of the data collection and use practices of the Sites. 

Amendments to this Policy will be posted on the Sites and will be effective when posted.  Your continued use of any of the Sites following the posting of any amendment will constitute your acceptance of that amendment, except if your personally identifiable information will be used in a materially different manner.  See the Notification of Changes section below for further information.

Registered Users. 

Registration is not mandatory to access the public areas of the Sites.  Registration is, however, required for access to certain areas of the Sites and the products and services provided through those areas of the Sites.  The areas of the Sites requiring registration are noted on the Sites.  Users registering for any of the Sites will receive an account on such Site and will be provided with a username and password for purposes of accessing their account and the portions of such Site available to registered users.  When accessing the portions of the Sites available to registered users, registered users will be asked for their username and password.  Always remember that in order to protect your privacy you should not share your username or password with others. 

Personally Identifiable Information. 

We only collect and share personally identifiable information regarding users of the Sites as described in this Policy.  Except as noted in this Policy, personally identifiable information collected on the Sites is NOT shared with third parties without your consent. 
Our server may automatically collect your domain name when you access the Sites. 
We may also collect personally identifiable information from you through a number of voluntary sources on the Sites such as emails, postings, messages or other electronic communications sent by you to Wagner Custom or to any of the Sites.  We may also collect any of the following types of personally identifiable information from you:

• Survey Information, including, but not limited to, skiing preferences, buying preferences, hobbies, height, weight, shoe size, and birth date and year;

You should not provide Wagner Custom with any personally identifiable information (or send or post any personally identifiable information to the Sites) unless you would like that information to be used by Wagner Custom in accordance with this Policy.  Likewise, you should not post any personally identifiable information to the Sites unless you want that information to be accessible by other users of the Sites, as information posted on the Sites will be made available to other users of the Sites. 

The personally identifiable information that Wagner Custom collects from users of the Sites (both registered and unregistered) may be used for a variety of purposes, for example to provide the services and products offered through the Sites to users of the Sites, to customize content and/or layout of the Sites for each individual user of the Sites, to notify users of the Sites about updates to and activities on the Sites and about goods and services that we feel may be of interest to you, to improve the content of the Sites, to analyze data and patterns regarding usage of the Sites, to contact users of the Sites for marketing purposes, and to contact users of the Sites for information verification purposes. 

We may also share certain personally identifiable information we collect through the Sites with third party companies.  We may share personally identifiable information with third party companies, so that they may offer products and services to users of our Sites that we believe will be of interest to those users. We may also share certain personally identifiable information with third party advertisement serving companies to better target the advertising displayed on the Sites and provide pertinent offers we think may be of interest to our users.  In addition, third party advertisers may receive certain personally identifiable information about you if you click on advertisements displayed on the Sites (and clicking on any advertisement displayed on the Sites will be considered your consent to “opt in” for this transfer).

Disclosure as Required by Law.  

Though we make every effort to preserve user privacy, we may need to disclose personally identifiable information of certain users of the Sites when we have a reasonable and good-faith belief that the disclosure is necessary to comply with a current judicial proceeding, a court order, or legal process served on our Sites.  In such a situation we will use reasonable efforts to provide notice of this disclosure in advance to users, to the extent reasonably possible under the circumstances. 

Enhancement of Personal Information.  

We may enhance our user database information with third party data to better target our advertising and provide pertinent offers we think our users would be interested in.  Certain summary demographics are also used in our research product offerings.  Individual personally identifiable information is never used in our research product offering and is never tied back to an individual user or resold for any purposes. 

Service Announcements.  

On occasion it is necessary to send out service related announcements.  For instance, if our Sites or any of the services offered through the Sites are temporarily suspended for maintenance we might send users an email.  Generally, users may not opt-out of these communications, though they can deactivate their account.  These communications are not promotional in nature.

Special Offers and Updates.  

We send all new registrants of the Sites a welcoming email to verify password and username.  Established members will occasionally receive information on products, services and special deals, and periodic newsletters.  Out of respect for the privacy of our users we present the option to not receive these types of communications.  Please see the Choice and Opt-out section.

We provide you with the choice whether to receive certain emails. 
We provide you the opportunity to 'opt-out' of having your personally identifiable information used for certain purposes.  If you no longer wish to receive email or mail from us, you may opt-out of receiving email or mail from us by emailing us at info@WagnerSkis.com.  You may also opt-out of receiving email from us by entering your email address into the box on the unsubscribe page located at http://www.wagnerskis.com/about/unsubscribe.php.  If you no longer wish to receive telephone calls from us, you may opt-out of receiving phone calls from us by emailing us at info@WagnerSkis.com or calling us at 970-728-0107.  We also offer an opportunity to opt-out of having your personally identifiable information or email address shared with third parties by emailing us at info@WagnerSkis.com. 

Customer Service.  

We communicate with users on a regular basis to provide requested services and with regard to issues relating to their account, we reply via email or phone, in accordance with the users' wishes. 

Non-Personally Identifiable Information. 

Where possible, our server automatically recognizes each visitor’s domain name and Internet Protocol addresses.  We also collect information about how visitors use the Sites (for example what pages are viewed).  This information, which is collected and maintained in anonymous and in a non-personally identifiable form, allows us to improve the content of the Sites and facilitate market research.  Sometimes, we utilize the services of a third party to help us understand this information better, although the information that is disclosed to these entities remains at all times in anonymous and non-personally identifiable form.  Other than improving the Sites and providing our visitors with the best experience possible, we make no other use of this information. 

Cookies. 

"Cookies" are commonly used pieces of information in the form of small files that are placed on an individual's computer hard drive to enable the individual to more easily communicate and interact with the Sites.  We use cookies for various purposes, for example to save user preferences, to record session information, such as items that users add to their shopping cart, and to save certain information about users of the Sites and others who visit the Sites, in order to facilitate and enhance interaction with the Sites.  Wagner Custom does not use cookies to retrieve information from a computer that is unrelated to Wagner Custom or the Sites. 
We do not link the information we store in cookies to any personally identifiable information you submit while on our Sites.

Access, Review, Update.

Other Web Sites; Links. 

The web sites of Wagner Custom’s affiliates, promotional partners, advertisers, sponsors, and other third-party web sites may be accessible through our Sites.  These third party web sites have their own privacy and data collection policies and practices.  Wagner Custom is not responsible for any actions or privacy policies of such third parties.  You should check the applicable privacy policies of those third parties when providing personally identifiable information through linked web sites. 

Consent to the Use of Third Party Providers. 

In addition to the specific third parties noted in this Policy, Wagner Custom may also contract with other third parties to provide various services to Wagner Custom relating to the Sites on an outsourced basis rather than performing the services itself.  For example, Wagner Custom may contract with an email provider to handle the distribution of email messages to members of the Sites.  Likewise, Wagner Custom may contract with a web sites hosting provider to host all or a portion of the Sites for Wagner Custom.  By visiting the Sites, all visitors consent to Wagner Custom providing both personal and non-personal information received from those visitors to these third party providers for the purpose of enabling the third party provider to provide these outsourced services to Wagner Custom.  In addition, all visitors consent to the collection, maintenance, and processing of their personal and non-personal information by Wagner Custom and these third party providers. 

Notification of Changes.

Security. 

We will use industry standard security measures on the Sites to protect the loss, misuse and alteration of the information under our control.  While there is no such thing as "perfect security" on the Internet, we will take all reasonable steps to insure the safety of your personal information.
Only employees who need the information to perform a specific job are granted access to personally identifiable information.  Furthermore, ALL employees are kept up-to-date on our security and privacy practices.  Finally, the servers that we store personally identifiable information on are kept in a secure environment.
